It seems to me, however, that we are not without evidence to settle this-point. These two practices existed side by side at the time the generals were brought to trial after the battle of Arginusae. For Euryptolemus quotes two laws by which they could be tried the decree of Cannonus1 ordering, that if any one wrong the people of the Athenians, he shall plead his cause in chains before the people and, if condemned as guilty, shall be put to death and thrown into the barathrum, ' and the law against traitors and sacrilegious men, which orders that such should be tried in a court of justice and if condemned, shall be refused burial in Attica. But since the practice of casting into the barathrum is not mentioned after that trial, whilst the law against traitors, refusing them burial in Attica, was in force shortly before (in 411) and continued to be so ever after that time, the conclusion may be drawn, that some time after the trial of the generals the practice of throwing the bodies of criminals into the barathrum was discontinued.
