Excerpt from The Encyclopedia of Evidence, Vol. 12As was said in the case of Printup Johnson, 19 Ga. 73: If the agree ment was such a one that was re quired to be in writing by the stat ute of frauds then it is to be pre sumed that the agreement was in writing, for it is, in general. To be presumed, until something to the con trary be shown, that no man does what the law forbids, or what the law declares shall be invalid. And in the case of Stillwell v. Hanna, 97 mo. 579, 11 S.
