The tender also contained a fur ther demand that if defendant refused to accept the sum Of one thousand dollars tendered, and to execute a deed, that defend ant return to plaintiff the sum of three hundred and eighty-two dollars and fifty cents paid it on account of the contract, all Of which was refused by defendant.
