May It Please Your Honor:
I regret that the opportunity to prepare for this argument in the manner I could have wished, was not afforded me. It happened that by the first arrangement between myself and colleagues, the part assigned me was to assist in taking care of the case in the Appellate Court, to which the cause is to be taken in any event. The arrangement, however, was afterwards changed, but at so short a date before the time appointed for the hearing here, that my preparation has necessarily been hurried and unsatisfactory.
I do not advert to the subject by way of excuse for an effort which cannot, I well know, be the subject of much notice any where, but because it is due to your Honor, if my remarks shall happen to be more desultory than is common with me, that you should be informed of the reason of it.
The cause in every view we can take of it, is one of vast importance - involving interests of greater magnitude than any controversy which has arisen in the Courts of this State within my recollection.
