Excerpt from Reports of Cases Argued and Determined in the English Courts of Common Law, Vol. 3: With Tables of the Cases and Principal Matters, Containing Cases at Nisi Prius, in the Years 1815, 1816, 1817, 1818, and 1819It is not usual, and scarcely possible, for the Judges at Msi Prius, in the vast multitude of Cases brought before them, to do more than touch upon the principles of the Cases in point and, still less, to unfold the system of law, of which such Cases are but individuals. - In the form of Notes, the Writer has endeavored to supply this connection and exposition. The very limits of a Note necessarily require the con densation of the subject matter into points, and though this form of writing may not he the most elegant, and necessarily presumes a good degree of elementary knowledge in the reader, it is scarcely requisite to inform the student in the Law, that, when appended to decided cases, it is most useful for memory, reference, and study.In this attempt the writer feels that he has to contend with the salutary prejudice always existing against innovation in. Any thing deemed established.
