Excerpt from Reports of Cases Argued and Determined in the Court of Appeals of Maryland, Vol. 8: Containing Cases in 1836-7In this cause it is admitted, that a certain Col. John Stewart, of Somerset county in the State of Maryland, in his life-time, was seized and possessed in fee of the land in the declaration mentioned, and being so seized and possessed thereof, in the year 1794, died intestate, leaving a son called ¿lexander, and a daughter called Jane, of full age, his only children and heirs at law that the said Jane, after the death of her father, employed an overseer and cultivated the said land, and received the issues and profits thereof until her death, that the said overseer acted and managed the said' land entirely under her direction, without the control or inter ference of any other person, and the wages of the overseer and expenses of iron work, in carrying on the said farm were paid by the said Jane, during her life-time. That her brother ¿lexander Stewart, after the death of his father and during the life-time of the said Jane, held and occupied all the other lands, Of which the said Col.
