Mittleberger, one of the defendants, allows judgment to go by default, the other defend ant, Merritt, pleads the general issue, and two Special pleas, which the plain tiffs deny, and the case is turned into e'special verdict to raise the question of Merritt's liability as a partner with John Mittleberger and Company, upon the finding of the jury as follows That the defendants, William Hamilton Merritt and John Mittleberger, together with George Adams and Beacher Benham, did d'uly execute and deliver as their act and deed, certain articles of agreement bearing date the 28th day of August, 1839, which said articles are in the words and figures following, that is to say Articles of agreement made, entered into, 'and concluded, upon this 28th day of August, 1839, between William Hamilton Merritt, of the village of St. Catharines, in the district of Niagara, and province of Upper Canada, Esquire, and George Adams, of the same place, Esquire, of the one part, and John Mittleberger, of the same place, merchant, and Beach er Benham, of the same place, distiller, of the other part, whereas the said William H.
