Farber and Peter Bridge in New Jersey, have been jailed.7 It would not be surprising if more than one newsman has backed off of a controversial story for his per sonal well-being.Aside from the threat of jail is the problem of the incapacitating worry and hassle - the concern for ethical standards, personal safety, and the loss of time spent with attorneys.8 Support ers of legal protection for newsmen claim that reporters should not have to endure these hardships as a result of providing information to the public.The threat of a subpoena presents other serious implications for the news process: A newspaper or broadcast sta tion may have to spend a considerable amount of time and money responding to charges by someone who has been legitimately stung. The victim may sue for libel, perhaps to intimidate the media or to determine the confidential source.
