Excerpt from Opinion of the Supreme Court of Appeals of Virginia in Regard to Liability to Military Service of the Principals of Substitutes The power of coercing the citizen to render military service for such time and under such circumstances as the goyernment may think fit, is in deed a transcendent power, but so far from being inconsistent with liberty, it is essential to its preservation. A nation cannot foresee the extent of the dangers to which it may be exposed. It must, therefor, grant to its government a power equal to every possible emergency: and this can only be done by giving to it the control of its Whole military strength. The danger that the power may be abused, cannot render it preper to withhold it, for it is necessary to the national life. The hazard of abuse should be guarded against by so framing the government as to render it unlikely that it will use the power Oppressively.
