Excerpt from Massachusetts Reports, Vol. 209: Cases Argued and Determined in the Supreme Judicial Court of Massachusetts, May 1911-September 1911After the verdict, 1: which was returned on January 18, 1910, and after the filing of the bill of exceptions but before it was allowed, the defendant filed a motion to dismiss the action on the ground that the plaintiff corporation was dissolved by St. 1907, c. 290, which took cfiect on April 18, 1907. Section 2 of this act provided that nothing in this act shall be construed to affect any suit now pending by or against any corporation mentioned in the first section of this act. Suit is used in this statute as a comprehensive word To apply to any proceeding in a court of justice, by which an individual pursues that remedy in a court of justice, which the law affords and includes an ac tion at law.
