And in another case, a paper addressed by a testator to his execu tore was held not to be testamentary, the same not being dispositive in terms, nor shown by extrinsic evidence to have been so intended. In this case Sir Herbert Jenner observed that there was distinction in the consideration of papers which are in their terms dispositive, and those which are of an equivocal character, that the first will be entitled to pro hate, unless, as in Nicholts v.
