Previous chief counsels have not chosen to use that. I did choose to use that and fortunately in both cases after the agencies were notified, once after filing a notice with the court of appeals that we were going to file an amicus, the agencies have come into compliance with the Regulatory Flexibility Act and modified their regulations to lessen the burden on small business.
