The report which he then prepared became a precedent and has been fol lowed in similar cases in Kentucky ever since. There were three candidates for the legislature from a certain district. The one who had the greatest number of votes proved to be disqualified as he at that time held another office. It was claimed that the candidate having the next highest number of votes was then entitled to a seat. Clay denied this asserting that there was no election.
