For this purpose, the preferential treatment of works councils as is regulated by law and that of trade unions as is not regulated by law are being compared in order to develop legal responses for both. In doing so, illegal and legitimate forms of preferential treatment are being defined, the existing sanction mechanism is being explored, and possible solutions are being identified.
