»The Unborn Contradiction: The Symbolic Protection of Human Life in Vivo, and Its Continued Influence in an Allopoietic Criminal Legislation« German Criminal law shows a number of inequalities with regards to the protection of human life against killing or injury in its pre- and postnatal stages. Taking as its point of departure the rulings of the Constitutional Court on the subject, the study devotes itself to the question whether there are objective reasons for these inequalities. A differentiated analysis of relevant legislation finds that symbolic criminal legislation functionalises legal contradictions, and consequently undermines the autopoietic self-understanding of the legal system.
