Excerpt from At the General Assembly of the Governor and Company of the English Colony of Rhode-Island, and Providence-Plantations, in New-England, in America: Held by Adjournment at Providence, on the Last Tuesday of February, One Thousand Seven Hundred and Fifty-Three, And in the Twenty-Sixth Year of the Reign of His Most Sacred Majesty, George the Second Whereas Caleb Greene, Efq, Clerk of the Town of Coventry, in the County of Kent, reprelented unto this Alfembly, that Benja min Nltbolr, late of faid Coventry, preferred a Petition unto the General Affembly, at a Semon holden in Newport on the third Monday of finger/1, One Thoufand Seven Hundred and Forty-nine, fetting forth, that he had given a Mortgage Deed, with one Set of Bonds to the Grand Committee, and another Set unto the General Treafurer, for the Principal and Interefl ofa Sum of Money by him taken of the Colony upon Loan, which Mort gage and Bonds had been altered after his Execution of them Whereupon the General Affembly appointed a Committee to ih fpcEURl the faid Mortgage and Bonds, and make Report to the General Affembly at their next Seflion and by the fame A6}. Prohibited the putting in Suit the Mortgage and Bonds aforefaid, till they fhould give farther Orders That the faid Benjamin Ni-s (bub hath fl'lcc that Time dtfpofed ofthe Land mortgaged to the Colony as aforefaid, to Richard Tree of Coventry abovelaid That the faid Committee having made no Report in the Affair, there hath been no Provifinn made for the faid Benjamin Niebob's Relief (ifany he ought to have): That as there is a Law ofthe Colony, which forbi is the Recording any Deed or Conveyance of Lands mortgaged to the Colony, before the lnterefi Bonds are exchanged in the General Treafurer's Office. His the [kid Richard Tree's Deed remains unrecorded, to his great Detriment, as it may happen, And upon the whole prayed, that fome Method may be pointed out for the Remedying of the Grievance aforefaid.
