He writes: "I suppose that even the world itself could not contain the books that should be written: Amen."Certainly, the American lawyer of this day and generation has many books left on his table for examination, which, he concludes, might just as well not have been written, and even those which he feels he must get, make a pretty large item in his annual expenses.Under such conditions, one who launches a new craft in the overgrown fleet of legal literature owes at least an explanation to the profession.The plea, which the writer of this unassuming work interposes is one which is generally deemed sufficient, under any system of jurisprudence, whether rude or refined, - that of self-defense.For many years past the writer has lectured in the law school of the New York University upon the subject of practice under the New York Code of Civil Procedure.Sundry students who have attended these lectures, with the benevolent purpose of serving their associates, and, incidentally aiding themselves, have prepared and sold reports of these lectures, all more or less imperfect. The continuing annoyance of these inaccurate preparations has made it necessary to supersede them. Hence this volume.
